The Latest on Coloplast Vaginal Mesh Claims

The Coloplast vaginal mesh lawsuits have joined four other vaginal mesh products in the United States District Court for the Southern District of West Virginia. Judge Joseph R. Goodwin is currently supervising the following litigation:

  • MDL-2325: In Re: American Medical Systems, Inc., Pelvic Repair System Products Liability Litigation (1,225 cases)
  • MDL-2326: In Re: Boston Scientific Corp. Pelvic Repair System Products Liability Litigation (885 cases)
  • MDL-2327: In Re: Ethicon, Inc., Pelvic Repair System Products Liability Litigation (1,320 cases)
  • MDL-2387: In Re: Coloplast Corp. Pelvic Support System Products Liability Litigation (33 cases)

The Coloplast litigation was approved by the Judicial Panel of Multidistrict Litigation on August 6, 2012. Victims argue that the mesh devices are defective, poorly researched and tested, and failed to include proper warnings.

Coloplast’s Products

Coloplast manufactures three vaginal mesh products, including Exair Mesh, Novasilk Synthetic Flat Mesh, and Restorelle Smartmesh. It also makes five bladder sling products, including Aris Transobturator Sling, Omnisure Sling, Minitape Sling, Supris Suprapubic Sling, and T-Sling with Centrasorb.

Status of the Coloplast Litigation

The Coloplast litigation is consolidated in a type of class action known as multidistrict litigation. Unlike a class action, the lawsuits do not attempt to represent all people who have had Coloplast mesh implanted. It is very important, therefore, for anyone who has had vaginal mesh injuries to seek counsel and file an individual lawsuit. Those lawsuits that are filed in federal court will be automatically transferred to Judge Goodwin in West Virginia. Judge Goodwin will oversee all of those cases, and will make sure that discovery is streamlined and that the cases proceed efficiently. In upcoming years, it is possible that he will be able to push for vaginal mesh settlements.

On September 21, the judge spoke to the lawyers, who informed him that they are working on a discovery plan that includes preliminary plaintiff fact sheets (general information about each victim, their mesh surgery, and medical histories). The next Coloplast status conference is set for November 2, at which point a more formalized discovery plan may be created.
