Earlier this year, we told you that the MDL Judge overseeing the Actos class action lawsuits was proceeding forward with vigor, with hard and fast dates for the two pilot bellwether trials to get the Actos MDL over and done with in a “reasonable time frame.” We now know when this will be.
The first federal Actos MDL trial will begin on January 27, 2014, in the U.S. District Court for the Western District of Louisiana, with the second trial set to begin on April 14, 2014, unless there is “extraordinarily good cause shown” why the case should be continued or delayed.
Meanwhile, the very first Actos trial continues in California, having started in mid-February. The trial is expected to conclude this month. This lawsuit was initiated by a man diagnosed with bladder cancer in November 2011, after having used Actos for more than two years.
The judge for the MDL ruled that any Plaintiff in the two bellwether trials must have bladder cancer. But, while studies have shown that individuals taking Actos are at a greater risk for bladder cancer, studies have also shown that they are at a greater risk for heart attacks and death.
