The Latest on Vaginal Mesh

The FDA believes that between 30 and 50 percent of all women will experience some degree of pelvic organ prolapse during their lives. Pelvic Organ Prolapse (POP) is a serious condition where the tissue that holds the uterus, bowel, bladder and rectum in position becomes weak and the organs slip in the body cavity. Mesh was designed to provide extra support for those organs. Unfortunately, much of the mesh being used is defective, and causes serious medical problems, including:

  • Bleeding
  • Pelvic pain
  • Urinary problems
  • Painful sexual intercourse
  • Infection

Vaginal Mesh Lawsuits

There are several hotbeds of vaginal mesh litigation. Many of the cases against individual companies have been grouped together and consolidated for the purposes of discovery. Like a class action, these vaginal mesh MDLs are unified, and one judge will oversee them all. Unlike a class action, the cases may return to their home states after discovery is finished. Sometimes, however, the cases will settle shortly after the discovery phase.
Here is a quick update on the various vaginal mesh litigations:

  • Georgia (Mentor): there are now 112 individual cases pending
  • New Jersey (Ethicon/Johnson & Johnson, C.R. Bard): Initial trials are set to begin in November, 2012
  • West Virginia (Boston Scientific, Ethicon/Johnson & Johnson, AMS, Coloplast, C.R. Bard): One case has gone to trial against C.R. Bard, with a plaintiffs’ victory of $5.5 million.
