Texas Average Personal Injury Jury Verdict

I've written in the past about personal injury verdicts in Texas. A recent Jury Verdict Research found that the average verdict in a personal injury lawsuit in Texas is $826,892. But Texas is a particular example of the differences between the median and average jury verdicts: the median award is just $12,281. You can always drive a truck between the difference between average jury verdicts and median jury verdicts. But it Texas, this gap would not covered by a fleet of trucks.

The average is also distorted by huge verdict that are not collectible. A Texas jury awarded $118 million - the highest verdict included in this Texas jury verdict study - to the widow of a worker who died in Phillips Petroleum Co. explosion but the Texas cap on punitive damages reduced that award to under $12 million.

Police Negligence Lawsuits: Average Verdict Data

Jury Verdict Research reports that plaintiffs injured by police negligence were awarded damages in 38 percent of police negligence lawsuits. The average jury award in police negligence lawsuits is $1,507,918 (the median is $114,564).

Radiation Overdose Lawsuit

The South Carolina Lawyer Blog has a blog post about a malpractice/product liability lawsuit involving the radiation overdoses at Cedar-Sinai Medical Center which the Maryland Medical Malpractice Lawyer Blog posted on last week.

Sometimes it makes sense tactically to file a lawsuit quickly. But it seems that the only cases that get filed in less than a few weeks are those cases that coincidentally happen to make headlines.

Zometa Lawsuits

A Montana jury has awarded $3.2 million to a woman attributing degenerative jaw problems after taking to bone-strengthening drug Zometa. In the lawsuit against Novartis Pharmaceuticals, the Plaintiff alleged Novartis failed to warn that Zometa could cause osteonecrosis.

This is a big victory for plaintiffs in the Zometa lawsuits.

Bayer Still Rules

This is hysterical:

Datamonitor attended this year's International Federation of Gynecology and Obstetrics World Congress in Cape Town to assess the state of the women's healthcare market. The overwhelming presence of Bayer-Schering at the conference confirms the company's strength in the contraceptives field and its commitment to maintaining its market-leading position.

Bayer is getting lawsuits from everyone, including their own investors, over the debacle that is Yaz/Yasmin. Yet Datamonitor went to "assess the state of the women's healthcare market" and found Bayer still rules the roots. Datamonitor also went to access at the state of David Letterman's marriage and found it better than ever.

This is all so "George Bush sitting inside the bubble being told how everyone loves him" esque. It is great to have a posse like Bayer appears to have that always tells you how great you are. For $125, Datamonitor will send you a SWOT analysis of Bayer AG. I'm tempted to get it just to see it if is more or less of a puff, cheerleader piece than the program you get at a Baltimore Orioles game. Vegas odds: push.

Settlement in Boston Malpractice Lawsuit

Boston Medical Center has reached a settlement of $900,000 with the family of an 86-year-old woman who died after falling in an operating room following hip surgery. The family's lawyer alleged in a lawsuit that the hospital staff did not take the appropriate precautions when the woman was put in her hospital bed. One driving force for settlement: a Massachusetts state inspection found that deficiencies in procedure contributed to the death.

Huge Cerebral Palsy Verdict for 1984 Birth

A Saratoga County, Washington jury awarded $43.5 million last week to a woman who sued the former Bellevue Maternity Hospital in Niskayuna for severe brain damage she suffered during her birth in 1984.

While the Plaintiff is blessed with above-average intelligence with a degree from Arizona State University, she uses a wheelchair and lacks motor skills due to the brain damage from cerebral palsy.

How does a cerebral palsy case with such tremendous upside go to trial? Defendant's cerebral palsy lawyer reportedly turned down a high/low of $2 million/$300,000. Usually, cerebral palsy cases go to trial because one side miscalculates, which appears to be the case by the hospital in this case.

Alabama Average Medical Malpractice Settlement

Because our lawyers handle cases in different jurisdictions, I have a keen interest in average verdicts and settlements in different states. The dynamics of every state is different.

I found this data from the Alabama Jury Verdict Reporter providing average malpractice verdict data in Alabama for 2005:

So, essentially, the average medical malpractice lawsuit in Alabama that went to trial was $449,474 overall with plaintiff's winning 30.3% of trials. In trials won by Plaintiff, the average verdict was $1,484,309. (In case this is not clear, the former statistic includes in the average malpractice cases that were lost.

It is very interesting to learn that wrongful death medical malpractice plaintiffs prevailed in only 13.6% of cases and living (presumably unless they died of an unrelated cause before trial) medical malpractice plaintiffs won 44.7% of their cases. But medical malpractice lawyers in Alabama deciding whether to take on a case should note that the average plaintiff's verdict in wrongful death malpractice cases in Alabama is $4,536,111.

Georgia's Cap in Medical Malpractice Cases

Maryland and Georgia both have rulings on tap from their high courts on caps on economic damages. Georgia got the ball rolling yesterday when the Georgia Supreme Court heard arguments yesterday on whether its cap on damages for medical malpractice claims is constitutional. A Georgia medical malpractice lawyer argued for the Plaintiff that the tort reform law in 2005 is unconstitutional because it grants unfair preferences and exemptions to hospital emergency departments.

Plaintiffs have a real shot in this case. The Georgia high court has previously stuck down laws that gave special exemptions to asbestos manufacturers facing property claims. Stay tuned....

Big Verdict in Indiana

An Indiana jury has ordered a group of highway contractors to pay $10.2 million to the family of a worker killed in a 2006 construction accident. In Plaintiffs' lawsuit, attorneys contended that the contractors were negligent for allowing workers to ride on an uncovered flatbed trailer and not requiring them to wear hard hats.

Not surprisingly, an attorney for the contractors said suggested Defendants intend to appeal the verdict.

Malpractice Award in Florida

A Florida jury has ordered two Coral Springs doctors to pay $4.3 million to the family of a girl who was misdiagnosed at birth in 1994. The jury determined that two doctors failed to perform tests required by the standard of care and failed to act on symptoms that showed the child had enterovirus, a usually mild illness that can cause death or serious injury in infants. This misdiagnosis left the girl with severe vision problems and permanent liver cirrhosis.
